Hamilton, Ohio (CBS CLEVELAND) – On Ohio man with a history of engaging in public sex acts with pool rafts was arrested Wednesday morning, accused again for the same alleged behavior near a highway.
Police say Edwin Tobergta, 35, was seen having simulated sex with a pink life raft on Route 4 around 8 a.m. on Wednesday, WLWT-TV reports. Last November, Tobergta was sentenced to jail for 11 months after stepping out of his home naked and “having sexual relations with a pool float” within the view of a 10-year-old child. And in 2011, Tobergta was also arrested after sexual conduct with a pink inflatable swimming pool raft, according to police reports.
Tobergta was released from prison on May 17, with five years of parole, according to the Ohio Department of Rehabilitation and Corrections website.
According to Journal-News, Tobergta told the judge at the time of sentencing, “I do want to apologize for my actions. I’m sorry I do deal with mental health issues, and if court would give me this chance for this program, sir, I would give it 100 percent. I’m ready to get my life together and quit all this nonsense.”
In 2008, Tobergta was convicted of a felony public indecency charge and sentenced to five years of community control after police were called to reports of a naked man standing in a neighbor’s yard and engaging in some type of sexual activity, according to records obtained by the Journal-News.
Following the 2011 arrest, a family member of Tobergta’s said he has mental health issues and needs help, but it was unknown if he underwent treatment.
In his latest booking photo, Tobergta is seen wearing a T-shirt that reads: “I’m out of my mind. Please leave a message.”
Tobergta’s court hearing is set for June 18 and he is being held on $35,000 bond.
